Texas Community Experts respects the intellectual property rights of others and expects users to do the same. In compliance with the Digital Millennium Copyright Act (DMCA), a process has been established for the removal of infringing content from the website.

If you believe that content on our site is infringing upon your copyright, you may submit a proper notification following the steps below. 

Filing a DMCA Complaint

To file a DMCA complaint, provide the following information in writing to our designated DMCA agent:
  1. Identification of the copyrighted work: A description of the copyrighted work that you believe is being infringed, or if multiple works, a representative list.
  2. Identification of infringing material: Details about the material you claim is infringing, including the URL or information sufficient to locate the content on our website.
  3. Your contact information: Include your name, address, telephone number, and email address where you can be reached.
  4. A statement of good faith: A statement affirming your belief that the use of the material is unauthorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: A declaration that the information in your notification is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  6. Your signature: An electronic or physical signature of the copyright owner or their representative.

Upon receiving a valid DMCA notification, we will promptly investigate and take appropriate action, including removing or disabling access to the allegedly infringing material if necessary.

Filing a Counter-Notice

If your material has been removed due to a DMCA complaint and you believe it was done in error or  misidentification, you may file a counter-notice. The counter-notice must include:

  1. Identification of the removed material: Describe the content that was removed and provide the location where it appeared before removal.
  2. Your contact information: Include your name, address, telephone number, and email address.
  3. A statement of good faith: A declaration that the material was removed or disabled due to a mistake or misidentification.
  4. A statement of consent to jurisdiction: Affirm that you consent to the jurisdiction of the federal district court in your area (or if you are outside the U.S., the court where our company is located) and that you will accept service of process from the original DMCA complainant or their agent.
  5. Your signature: An electronic or physical signature.

Consequences of Misusing the DMCA Process

Be aware that under Section 512(f) of the DMCA, anyone who knowingly makes false claims in their notice or counter-notice may be held liable for damages, including attorney’s fees and court costs. Ensure that your claim is valid and made in good faith before submitting.
